Please read all the recommendations and guidelines before publishing your products

Customers know that they can buy with confidence on Inasbay at any time. Products sold on Inasbay.com must adhere to all applicable laws and regulations and Inasbay's standards. It is entirely forbidden to sell any illegal, dangerous, or otherwise restricted products described on these pages, including those available only by prescription.

To sell goods on Inasbay, you should read the Restricted Products Help pages carefully before listing a product. The examples presented in these Help pages are not exhaustive and are only intended to serve as a guide. Suppose you have any queries about the rules and regulations that apply to your products. In that case, we recommend that you consult with your legal counsel. All products and listings must conform to applicable laws, even if presented as an "Example of Permitted Listings." Furthermore, any links supplied are offered solely for informative purposes. Inasbay makes no representations of the authenticity of any material contained in these links.

Supply a product that violates the law or any of Inasbay's policies, including those listed on the Restricted Products pages. We will take appropriate corrective action, such as suspending or terminating your selling privileges, destroying inventory in our fulfilment centres without reimbursement, returning merchandise, terminating the business relationship, and withholding payments indefinitely. In addition, legal action, including civil and criminal sanctions, can result from selling unauthorized or hazardous products.

On behalf of our clients, we're continually inventing and collaborating with authorities, third-party experts, vendors, and sellers to better how we detect and prevent illegal and harmful products from entering our marketplace. Inasbay encourages you to report listings that violate Inasbay's policies or applicable law by contacting us. We will investigate each report thoroughly and take appropriate action.

Additional related policies

  • Certain categories require you to obtain pre-approval from Inasbay before listing in those categories.
  • Certain categories require you to provide additional information and/or a supplemental guarantee before listing in those categories.
  • If you wish to list items for international purchase, you are responsible for conducting proper research to ensure that the items listed comply with all applicable laws and regulations.
  • Products that claim to be "CFIA Cleared," "CFIA approved" or products that include the CFIA logo in associated images need to meet additional requirements by the Canadian food inspection agency

Alcohol

Examples of Permitted Listings

  • Wine sold by pre-approved sellers
  • Wine and beer-making kits and products that do not contain alcohol
  • Alcohol-related accessories and products, including corkscrews, decanters and containers
  • Alcohol-related memorabilia and collectibles that do not contain alcohol 

Examples of Prohibited Listings

  • Alcoholic beverages (except pre-approved wine sellers)
  • Liquor licenses
  • Any product marketed for customers over 21 years of age
  • Any product that encapsulates raw alcohol

Animals & Animal-Related Products 

Our Policy: You must follow all applicable federal laws when selling animal goods and animal-related products. You must also follow all appropriate state and local regulations in the jurisdiction where your items are marketed. You are also responsible for getting all necessary licences and permits and any penalties that may come from non-compliance.

The examples of authorized and forbidden listings that follow are not exhaustive. However, they should help you evaluate products for listing and sale.

Examples of Permitted Listings

  • Live shellfish and crustaceans
  • Live insects and worms used for agricultural purposes, bait, or pet food
    • Note: These are subject to geographic sales restrictions.
  • Products made to resemble prohibited animal parts or products that are not made from those animals. If the listing includes a clear title and description that the item is not genuine; for example, faux tortoiseshell is permitted if the listing states the item is fake or artificial.
  • Animal parts or products that are not otherwise restricted, such as:
    • Shark teeth jewelry
  • Veterinary diets are dog and cat food items designed to help manage the nutritional needs of animals in various stages of health, including those with illnesses and other disorders diagnosed by a veterinarian. Veterinary Diets should only be sold under the supervision of a veterinarian, according to the Canadian Food Inspection Agency (CFIA) and the US Food and Drug Administration (FDA). Here's where you can find CFIA guidelines. At the check-out page, Inasbay will ask for information from clients to certify that the product is being purchased under the supervision of a veterinarian.

Examples of Prohibited Listings

  • Animals are prohibited under the Endangered Species Act, "pest" species under the Canadian Forest Products Importers Act or products that contain or are infested with the above animals or their parts, eggs or offspring.
  • Animal feces
  • Live animals that are not insects, fish, shellfish, or crustaceans
  • Illegal wildlife products
  • Fish or wildlife that are taken, possessed, transported, or sold in violation of the Canadian Forest Products Importers Act
  • Food for pets or other animals that are not registered or licensed as required by law
  • Insects or other creatures designated as "plant pests"
  • Parts or products, including fur and feathers, from federally endangered or threatened species, such as:
    • Cheetah
    • Jaguar
    • Leopard
    • Mountain zebra and Hartmann mountain zebra
    • Sable antelope
    • Tiger
    • Polar bear
    • Ocelot
    • Wolf
    • Indian python
    • Crocodile
    • Alligator
    • Sea turtle
    • Colobus monkey
    • Vicuna
    • Spanish lynx
    • Elephant
    • Pangolin
    • Sea otter
  • Parts or products from bears or mountain lions; such as:
    • Bear bile
  • Parts or products from cats or dog
  • Products made from the skin of seals
  • Products prohibited for sale under the Migratory Bird Treaty Act of 1918
  • Products containing ivory from animals
  • Vaccines (including human and animal vaccines), such as:
    • Rabies

  • Products that contain parts or ingredients derived from sharks, whales, dolphins, or porpoises (with the exception of teeth, which are permitted), such as:
    • Joint pain supplements containing shark cartilage
    • Shark fin products
    • Shark liver oil
    • Whale meat
  • Tools and kits for ear cropping, tail docking, declawing or any other removal or modification of a companion animal’s appendage
  • Products that contain foie gras may not be shipped to addresses within the State of California.
  • Parts or products made from certain species listed below may not be shipped to addresses within the State of California:
    • Cobra
    • Python
    • Kangaroo
    • Feral horse
    • Porpoise


Drugs & drug paraphernalia

A drug is a substance that is used to diagnose, treat, prevent or cure diseases in humans or animals. Medications can also be used to alter the body's structure or function, such as in treating acne. Some pharmaceuticals, such as most antibiotics, require a prescription before being sold; however, others may be sold without a prescription because they have been licenced for over-the-counter sale by the CFIA.

“Controlled substances” (Unlawful drugs), such as cocaine or heroin, are classified as "controlled substances." Drug paraphernalia includes products that are used with restricted narcotics. Drug paraphernalia refers to items that are principally intended or designed for use in the manufacture, preparation, or administration of a restricted substance.

Please use the checklist below to be sure your product can be sold on Inasbay.

Compliance Checklist for Drugs & Drug Paraphernalia

  • Drugs must be sealed in the original manufacturer’s packaging
  • Drugs must be new and unused
  • Drugs must clearly display identifying codes placed on the packaging by the manufacturer or distributor, such as matrix codes, lot numbers, or serial numbers
  • Drugs must be labelled in English with the following information:
    • The title of the drug
    • The “Drug Facts” panel
    • The active ingredient(s)
    • The purpose(s) of the drug
    • The use(s) of the drug
    • Any required warning(s)
    • The directions for using the drug
    • Any other information, as required for the specific product
    • The inactive ingredients
  • The drug must use the claim “CFIA approved” appropriately
  • Drug labels must not use the CFIA logo

  • Detail pages must include the following information:
    • The name of the drug
    • The active ingredients
    • An image of the “Drug Facts” panel (and any “Drug Facts (Continued)” panels, if applicable) from the product label
  • Detail pages must comply with the approved labelling for the drug
  • Drugs must use the claim “CFIA approved” appropriately
  • Drug labels must not use the CFIA logo

Drug products and ingredients

  • Drug products must be approved by the CFIA for over-the-counter (OTC) sale
  • Drug products must not require a prescription or a medical professional's supervision or direction for their use, such as:
    • Prescription drugs and their active ingredients
    • Antibiotics (including "fish" antibiotics, both over-the-counter and prescription)
    • Prescription veterinary products and their active ingredients
    • Vaccines (including human and animal vaccines)
  • Drug products must not be named in a CFIA recall or safety alert (for more information, see: Recalls, Market Withdrawals, & Safety Alerts)
  • Drug products must not have been the subject of a Drug Enforcement Administration (DEA) emergency scheduling (for more information, see: CFIA Press Releases)
  • Drug products must not be named by the Federal Trade Commission (FTC) as making untrue marketing claims (for more information, see: Competition Bureau Canada)
  • Drug products must not be identified as adulterated (e.g. unsafe or lacking evidence of safety) or misbranded (e.g. having false or misleading information on the label) in an CFIA warning letter (for more information, see: CFIA Warning Letters)
  • Drug listings must not be for controlled substances or products containing controlled substances, such as:
    • Hemp products containing Resin or tetrahydrocannabinol (THC)
    • Hemp (or any cannabis Sativa spp. strain) seeds capable of germination
    • Anything listed in Schedules I, II, III, IV or V of the Controlled Substances Act (for more information, see: Schedules of Controlled Substances), such as:
      • Coca Leaves, including all variations of leaves, tea, and coca extract
      • Hallucinogenic mushrooms
      • Poppy pods, poppy straw, and poppy straw concentrate
    • "List I" chemicals or their derivatives as designated by the Drug Enforcement Administration (DEA) (for more information, see: List I and List II Chemicals), such as:
      • Ephedrine
      • Phenylpropanolamine
      • Pseudoephedrine
      • Ergotamine
  • Drugs listings must not be for substances identified by the Drug Enforcement Administration (DEA) as a drug or chemical of concern, such as:
    • Jimson Weed
    • Kratom
    • Salvia Divinorum
  • Drug listings must comply with Inasbay policies:
    • Loperamide listings are restricted to 48 mg of loperamide. Capsule and tablet loperamide must be packaged in blister packs. Images of the “Drug Facts” panel and Heart Alert Warning from the product label must be present on the detail page.
    • Listings for poppy seeds that make certain claims, including listings for poppy seeds that reference poppy tea, poppy seeds that are “unwashed,” poppy seeds that reference alkaloid content, and poppy seeds that reference opium are prohibited
    • Listings for products claiming to have psychoactive or hallucinogenic effects are prohibited, including “designer drugs” such as methoxetamine
    • Listings for products claiming to produce an effect similar to that of an anabolic steroid such as "Legal Steroids" are prohibited
    • Listings for products claiming to imitate the effects of a controlled substance, prescription drug, or substance identified by the CFIA as an unapproved new drug or tainted supplement are prohibited, including synthetic cannabinoids and bath salts
    • Listings for homeopathic teething tablets, pills, and similar products, and topical creams, gels, and similar products are prohibited
    • Listings for the active ingredients in prescription-only drugs are prohibited
    • Listing for injectable drugs is prohibited
    • Listings for products containing cannabidiol (CBD) are prohibited, including but not limited to:
      • Full-spectrum hemp oil
      • Rich hemp oil
      • Products that have been identified as containing CBD by LegitScript

Note: Inasbay prohibits the sale of Lugol's Solution containing more than 2.2.% iodine

Products associated with drugs and controlled substances

  • Products must not be primarily used for making, preparing, or using a controlled substance, such as:
  • Product listings must comply with Inasbay policies:
    • Products intended to defeat a drug test, such as urine additives and synthetic urine are prohibited
    • Tableting machines (commonly known as “pill presses”) or encapsulating machines (commonly known as “capsule fillers”), whether those devices are mechanical or manual, are prohibited
    • Tablet presses or molds used to press or imprint a pharmaceutical drug name or identification number onto a tablet or pill are prohibited
    • Listings for products that reference a product’s use with illegal drugs are prohibited
    • Listings for drug products that contain more than 2.2% iodine are prohibited, even those in an aqueous solution

Known prohibited products

The following drug goods, controlled substances, and products simulating drug products and controlled substances are strictly prohibited by Inasbay. These items are disallowed due to their failure to meet the checklist's requirements. This list does not include all of the drugs that Inasbay prohibits.

Explosives, weapons, and related items

You must follow all applicable federal laws when selling guns, imitation weapons, and accessories. You must also follow all appropriate state and municipal regulations in the jurisdictions where your products are offered and where you ship from. Many state regulations, for example, impose restrictions on the size, colour, and insignia of imitation firearms. You are also responsible for getting any relevant licences for approved products and for any fines that may follow from non-compliance.

The examples of authorized and forbidden listings are not exhaustive. However, they should help you evaluate products for listing and sale.

Ammunition

Inasbay prohibits the listing or sale of firearm ammunition and ammunition components for assault weapons, black powder guns, handguns, muzzleloaders, pistols, shotguns, and rifles.

Examples of permitted listings

  • Ammunition that does not contain lead or gunpowder such as:
    • BB, air, pellet, and airsoft ammunition.
    • Paintball gun paint pellets
    • Plastic non-explosive training aids, such as solid plastic ammunition

Note: These are subject to geographic sales restrictions.

Examples of prohibited listings

  • Firearm ammunition, such as:
  • Ammunition components, such as:
    • Black powder
    • Blanks
    • Bullets
    • Bullet tips
    • Casings
    • Gun powder
    • Primers
    • Shotgun Shells
    • Smokeless powder

Explosives

Inasbay prohibits the listing or sale of explosive devices and products that contain explosive materials.

Examples of permitted listings

  • Flares designed for safety, emergency, or distress signalling purposes
  • Plastic toy hand grenades

Note: These are subject to geographic sales restrictions and are not eligible for sale through FBA.

Examples of prohibited listings

  • Explosives, such as:
    • Fireworks
    • Flares, flare launchers, flare guns, flare gun receivers
    • Grenades, such as:
      • Military practice grenades
      • Rifle grenades
      • Smoke grenades
      • Metal replica grenades
    • Grenade launchers
    • Improvised explosive devices, including training aids, accessories, and certain explosive precursors
    • Mines
    • Projectile and concussive products that employ gunpowder or explosives

Firearms

Inasbay prohibits the listing or sale of all firearms, including assault weapons, black powder guns, handguns, muzzleloaders, shotguns, rifles, and starter guns. In accordance with the Firearms Act, the Canadian Firearms Program (CFP) oversees firearms licences and registration, maintains national firearm safety training standards, assists law enforcement agencies and aims to enhance public safety. Firearms in Canada continue to be regulated by the Firearms Act and Part III of the Criminal Code.

Knives and other bladed products

Inasbay policy prohibits the listing or sale of certain knives, including switchblades, balisongs, stilettos, and some blades designed to look like harmless items.

  • Knives: typical hunting or kitchen knives, such as:
    • Hunting knives
    • Kitchen knives
    • Replica swords
    • Machetes
    • Claw knives or karambit knives
    • Throwing spears and knives
    • Umbrella knives
    • Spring-assisted or assisted-opening knives that do not automatically extend

  • Automatic knives, also known as switchblade knives
  • Balisong knives, also known as butterfly knives, include some training knives
  • Concealed swords, including:
    • Cane-swords
    • Shobi-zue (a staff, crutch, stick, rod, or pole concealing a knife or blade within it)
    • Swordsticks
  • Gravity or gravity-assisted knives
  • Knives disguised to look like harmless items, such as:
    • Air gauge knives
    • Belt buckle knives
    • Comb knives or hairbrush knives
    • Lipstick case knives
    • Writing pen knives
  • Knuckle knives, including:
    • Fixed or folding blade knives with split knuckle duster handles
  • Pilum ballistic knives
  • Push daggers, including:
    • Punch daggers
    • Punch knives
    • Push dirks
    • T-handled knives
  • "Slasher" knives or other devices used in cockfighting
  • Spring-loaded knives
  • Stiletto knives
  • Throwing stars, including:
    • Batman symbols
    • Cyclone knives
    • Kung Fu stars
    • Metal throwing stars
    • Ninja stars
    • Shirken
    • Throwing cards

Other products

Inasbay prohibits the listing or sale of blunt force striking weapons, body armour, body armour plates, and other dangerous weapons or items that can be used as dangerous weapons.

Examples of permitted listings

  • Blowguns
  • Crossbows and other archery bows
  • Nunchaku with sticks made completely of foam, sponge, rubber, or another bendable substance
  • Handcuffs
  • Koga and kubotan
  • Night vision accessories
  • Pepper spray
  • Products with monkey fist knots that are made entirely of rope
  • Spearguns for spearfishing
  • Self-defence stinger tools
  • Slingshots, including wrist-brace slingshots.
  • Stun guns or electroshock weapons
  • Tactical pens
  • Torches, torch kits, and lighters for use in cooking or outdoor maintenance
  • Traps for small vertebrate animals (such as mice or rats) 

 

Food & Beverage

Organic products

Any food, seed or livestock feed labelled as organic is regulated by the Canadian Food Inspection Agency (CFIA). Producers of these products must be able to demonstrate that organic claims are truthful and not misleading and that all product-specific requirements are met. All foods sold in Canada must comply with the Food and Drugs Act and Regulations and the Canada Food Safety Act and Regulations.

Products must also meet the additional requirements provided in the Canada Food Safety Regulations in the following cases:

  • if they carry an organic claim on the label and are imported or sold in other provinces or territories
  • if they have the "Canada Organic" logo on the label and are sold in Canada or outside Canada.

In the above cases, CFIA relies on the services of a third party to ensure the compliance of organic products.

As of January 15, 2021, aquaculture products will be incorporated into the organic certification system of the Canada Organic Regime. Prior to this date, aquaculture products may be certified as organic on a voluntary basis. Please see the Organic Aquaculture Products page for more details. Hazardous and prohibited items

Examples of permitted hazardous listings

If listing a permitted but hazardous item, sellers must ensure they are shipping the item in compliance with Department of Transportation requirements and applicable laws.

  • Batteries that do not contain mercury
  • Rechargeable batteries
  • Portable fuel containers certified by the United States Environmental Protection Agency (EPA)
  • Firefighting foam products that contain perfluoroalkyl, or poly-fluoroalkyl (also known as PFAS)
  • Products containing nitrous oxides, such as nitrous oxide chargers and whippersÀ
